### GM agrees to pay $220 million to 36 attorneys general over selling Smart Driver trip data to brokers who resold it to insurers, and must get express consent and run privacy audits

A bipartisan coalition of 36 attorneys general (co-led by Washington and Oregon) announced the settlement on Oct 29. According to New York's announcement, from 2016 to 2024 GM enrolled millions of drivers in Smart Driver, which logged trip times, hard braking and acceleration, and speeding, and sold the data to data brokers under contracts meant for insurance products while telling drivers it would not share with insurers without consent.

- **Findings cited:** dealers were paid bonuses partly based on connected-service sign-ups and sometimes accepted terms on customers' behalf; the OnStar app told more than 370,000 enrolled drivers they were not enrolled.
- **Terms:** $220 million to the states (over $12 million to New York); limits on the driving data GM collects; an in-house privacy assessment program plus third-party assessments; dealer oversight and training.

**Take:** connected-car and telematics data is now firmly treated as sensitive personal data by state enforcers. If your organization buys or sells telemetry (vehicles, apps, IoT), check that consent was actually given by the person, not a sales intermediary.
